About the Seminar:

The talk will be focused on pacing of delays, a prevalent occurrence on construction projects both in Singapore and abroad. There is unfortunately little literature, and a paucity of legal authority on this difficult subject. Employers and contractors thus often find themselves at odds with one another over the practical effect of pacing in the context of delay claims. In this presentation, the speakers will explain:

1. what constitutes pacing

2. when contractors might pace on account of an employer delay

3. the practical impact of pacing delay, both on the project and on delay claims

The talk aims to create a better understanding of pacing and how it may be dealt with by both employers and contractors.

About the Speakers

Mr. Garry Crossley – Managing Director, Asia-Pacific Regional Offices, Navigant Consulting

Garry Crossley BSc, LLB (Hons), MBA, DipProjMan, MRICS is a Managing Director of Navigant Consulting’s Asia-Pacific regional offices. He advises clients internationally on project and programme delivery, strategic issues, contractual risks and contract strategy.
He has over 27 years’ experience in Transportation, Infrastructure and Building sectors throughout Asia, the Middle East, Eastern and Western Europe and Africa. He has been responsible for numerous international dispute and claim appointments on major engineering and construction projects. Garry has acted as Expert Advisor and Expert Witness in all phases of the arbitration and litigation process including preparation and exchange of reports, and has given evidence at hearings on numerous occasions.

Mr. Jon Prudhoe – Managing Director, Asia-Pacific Regional Offices, Navigant Consulting

Jon Prudhoe, FRICS, FCIArb, FAE, FSIArb is a Managing Director of Navigant Consulting’s Asia-Pacific regional offices. He has over 30 years’ experience of dealing with complex contract issues on building, civil engineering, infrastructure, transportation, process and energy sector projects with the past 15 years focussing on disputes in Singapore and across Asia. Jon has had over 80 appointments as Delay and / or Quantum Expert Witness and is well versed in giving evidence under cross- examination on matters of delay, disruption, acceleration and extension of time. He has also undertaken several Expert Determination and Dispute Review Board appointments.

About the Chairperson

Mr. Toh Chen Han – Council Member, Society of Construction Law; Partner, Pinsent Masons MPillay LLP

Chen Han is a Partner of Pinsent Masons MPillay. His practice focuses on commercial litigation in the Singapore Courts, International Arbitration, and Adjudication, as well as related advisory work. The cases on which Chen Han has acted involve a range of matters including tracing and restitution of monies, conspiracy, expressway design and construction, power plant engineering, procurement, construction, operation and maintenance, cargo-facility construction, water works, mixed research and commercial developments, and hotel management disputes.
Chen Han is an active member of the Council of the Society of Construction Law of Singapore, where he teaches Construction Law. He has written for the International Construction Law Review, and recently co-authored the chapter on Enforcement of Foreign Judgments and Foreign Arbitral Awards in Singapore, in the Law and Practice of Commercial Litigation in Singapore (Sweet & Maxwell, 2015).
